1. Scope and Consent

When you use the Site, you are contracting with PaymentsMD, which is located at 5665 New Northside Dr., Suite 330, Atlanta GA 30328. By using the Site, you expressly consent to our collection, use, disclosure, and retention of your personal information as described in this Privacy Notice.

2. Information We Collect

(a) Registration for Payment Portal: You can browse the Site without telling us who you are or revealing any personal information (e.g., name, email address, password, phone number, mobile telephone number, physical contact information or date of birth) about yourself. If you register for the payment portal, you choose to give us your personal information and are not anonymous to us. When you register for the patient payment portal you may provide personal information. Personal information is only associated with your payment portal account when you sign in as a registered user.
(b) One-Time Payments: When you make a one-time payment through the Site, we may collect (a) your PaymentsMD account number; (b) first and last name; (c) address and (d) payment information (e.g., credit card data) for processing your payment requests. Note that we do not store payment/credit card data, however, we will retain authorization codes for the transactions you request.
(c) Information to Process Your Billing Information Requests: If you request billing information for a patient in our database, we may request (a) the social security number for the patient; (b) your federal tax ID; (c) your email; (d) your response to a security question.
(d) User Log-in Attempt Information: We use our web server, to gather information from your browser, including IP address and username to monitor failed login attempts to anticipate and prevent interferences with user access to our Site.
(e) Tracking Technologies to Gather Technical Usage Information: When you visit our Site, we may from time to time collect usage information sent to us by your computer, mobile, or other access device that tells us how you are using the Site (“usage information”). We may use tracking technologies (including cookies (including cookies stored in HTML-5), web beacons/GIFs, embedded scripts, e-tags/cache browsers) to collect usage information.

Our goal is to collect and use only that information that we think is required for our legitimate business interests, in order to better understand your interests and improve your experience of using the Site. 3. Uses and Retention

(a) Operate Our Site: We use the information collected to (i) respond to your requests (e.g., for payment processing, copies of bills or for registration to our payment portal); (ii) provide customer service (e.g., to resolve disputes, problems with your account/profile or the Site); (iii) improve the Site; (iv) give you information about your account; and (v) provide you with a safe, efficient, and customized experience.
(b) Analyze and Aggregate Non-Personal Information: We use aggregate information about our users and non-personal information to analyze Site and user behavior as it relates to access and log-in attempts.
(c) Prevent Fraud: We use information from the Site to prevent, detect, and investigate fraud, security breaches, potentially prohibited or illegal activities, and enforce our Terms of Use.
(d) Communicate With You: We use your information to contact you to maintain the Site, your account, to provide other services requested by you, as described at the time when we collect the information from you, or contact you for other purposes authorized by law.
(e) Mobile Data: When you access the Site on a mobile device, we may use the information collected for any purpose set forth in this Privacy Notice.

We retain information as long as it is necessary and relevant for our operations.

4. Disclosure

Information collected on the Site may be shared with:

(a) ApolloMD Business Services, LLC: We may share the information we collect about you with ApolloMD Business Services, LLC and their and our affiliates and subsidiaries, as well as with third-party suppliers. The information may be disclosed, among other reasons, to: (i) process payments; (ii) facilitate Site registration; or (iii) help detect and prevent potentially illegal acts, violations of our policies, fraud and/or data security breaches.
(b) Service Providers and Other Third Parties: We may disclose your information to service providers under contract who help with our business operations (such as, but not limited to, payment processing, e.g. Moneris Solutions, Inc., insurers, attorneys and healthcare providers). We may also share your information with other third-party entities for which we provide billing services.
(c) Other Entities with Your Consent: Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
(d) Legal and Law Enforcement: Law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other PaymentsMD user to legal liability. In such events, we will only disclose information relevant and necessary to the investigation or inquiry, such as name, city, state, zip code, telephone number, email address, user ID history, IP address, fraud complaints and anything else we may deem relevant to the investigation.
(e) Change of Control – New Owners: We may share your information with other business entities, should we plan to merge with or be acquired by that business entity. Should such a combination occur, we will make reasonable efforts to request that the new combined entity follow this Privacy Notice with respect to your personal information. If your personal information would be used contrary to this policy, we will request that the new owner provide you with prior notice.
(f) Companies in The Mobile App Industry: If you access the Site through a mobile device, certain browsing information may be automatically shared with carriers, operating systems and platforms.
(g) Third Parties Pursuant to a Subpoena or Other Request: We may share your information with third parties in response to a subpoena, other legal process and/or as permitted by law.

You can control how and when you want to receive notifications from PaymentsMD on the Site or by following instructions within the notices. You may not opt-out of administrative emails (for example, emails about your transactions or policy changes) for your registered account.

6. Accessing, Reviewing, and Changing Your Personal Information

Registered members can review and change personal information at any time by accessing their accounts on the Site. You should promptly update your personal information if it changes or becomes inaccurate. We may retain some information from closed accounts so that we can comply with law, prevent fraud, assist with investigations, resolve disputes, analyze, or troubleshoot programs, enforce our Terms of Use, or take other actions permitted by law. If your account or membership is terminated or suspended, we may maintain some information to prevent re-registration.

7. Tracking Technologies

When you visit the Site, we and our business partners may use tracking technologies to gauge access to the Site.

A few additional important things you should know about our use of tracking technologies (e.g., cookies, HTML-5 stored technologies):
  • We may use both session and persistent tracking technologies. Tracking technologies (e.g., cookies) can either be persistent (i.e., they remain on your computer until you delete them) or temporary (i.e., they last only until you close your browser).   • Definitions
    Cookies A cookie (sometimes referred to as local storage object or LSO) is a data file placed on a device. Cookies can be created through a variety of web-related protocols and technologies, such as HTTP (sometimes referred to as “browser cookies”), and HTML5.
    Web Beacons Small graphic images or other web programming code called web beacons (also known as "1×1 GIFs" or "clear GIFs") may be included in our Site's pages and messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or email can act as a web beacon.

    Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to HTTP cookies, which are stored on a user's computer hard drive, clear GIFs are embedded invisibly on web pages and are about the size of the period at the end of this sentence.
    Embedded Script An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your device from our web server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.
    ETag, or entity tag A feature of the cache in browsers, an ETag is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of device identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and/or HTML5 cookies.

8. Notice to California: How We Respond to Do Not Track Signals

California Business & Professions Code Section 22575(b) provides that California residents are entitled to know how PaymentsMD responds to "Do Not Track" browser settings. PaymentsMD does not currently take actions to respond to Do Not Track signals.

9. Third Parties

Our Site may contain links to other third-party websites. We are not responsible for the privacy practices or the content of these third-party sites.

10. Security

We store and process your information on our servers located in the United States. We maintain technical, physical, and administrative security measures to protect the security of your personal information against loss, misuse, unauthorized access, disclosure, or alteration. Some of the safeguards we use are firewalls, data encryption, physical access controls to our data centers and information access authorization controls. It is your responsibility to make sure that your personal information is accurate and that your password(s) and account registration information are secure and not shared with third parties.

11. Children's Privacy

The Site is a general audience site and it is not intended for children under the age of 13 or minors under the age of 18. We do not knowingly collect personal information via our websites, applications, services, or tools from users in these age groups.
